Welcome to Up North Lifestyle Co. (“we”, “us”, “our”, “Up North”). These Terms & Conditions (“Terms”) govern your use of our website and your purchase of products. By accessing our site or placing an order, you agree to these Terms.
Important Note for Canadian Consumers: These Terms do not override your rights under applicable consumer protection laws, including the Consumer Protection Act (Ontario), the Consumer Protection Act (Quebec), and similar legislation in other provinces. Where these Terms conflict with mandatory consumer laws, the laws apply.

We operate as a dropshipping lifestyle brand. All products are fulfilled, printed, and shipped by Printful, Inc. (“Printful”). Up North Lifestyle Co. is the seller of record and responsible for your order.
For these Terms, 'business days' mean Monday through Friday, excluding statutory holidays in Ontario, Canada.
2. Use of Our Website
By using our website, you confirm that you are:

Using the site for lawful purposes only.

We may refuse service, restrict orders, or terminate access at our sole discretion.

3. Product Information & Availability
We strive to display accurate product details; however:

Colours may vary due to screen/monitor differences,

Sizes may vary slightly depending on the manufacturer (see size charts),

Product availability may change without notice,

Fulfillment and shipping are handled by Printful.
If a product becomes unavailable after your order is placed, we will notify you and issue a full refund.
4. Ordering, Payment & Cancellation
By placing an order, you agree:

All billing information is accurate,

You are authorized to use the payment method,

You will pay all listed charges (including applicable taxes).
Cancellation Policy
Once an order is submitted, production may begin within minutes. We cannot guarantee cancellation of any order after submission. If you email returns@upnorthlifestyleco.com immediately after ordering, we will attempt to cancel, but no cancellation is guaranteed. If cancellation is successful, you will receive a full refund. If production has already started, the order will ship and our standard return policy applies.
5. Shipping & Delivery Timeline
Estimated production time: 2–7 business days (Printful)
Estimated shipping time (after production):
Canada - 3-10 Business Days
United States - 4-12 Business Days
International - 10-20 Business Days
You acknowledge:

Shipping times are estimates, not guarantees.

Orders may ship in multiple packages.

Delays due to carriers, customs, weather, or Printful are outside our control, but we will assist in resolving them.

International customers are responsible for all duties, taxes, and customs fees.
Lost or Stolen Packages
If your tracking shows “Delivered” but you have not received the item within 3 business days:

Check with neighbours, building management, or your local post office.

Email returns@upnorthlifestyleco.com with your order number.

We will investigate with the carrier and Printful.
If the carrier confirms delivery to the correct address with GPS coordinates, we are not responsible for theft or loss after delivery. If the carrier cannot provide delivery confirmation, we will issue a refund or replacement at our discretion.
6. Returns, Exchanges & Refunds
Because all items are made-to-order, our standard policy is limited. However, your provincial consumer rights may provide additional protections (see Section 14).
6.1 Standard Policy (No Change-of-Mind Returns)
We do not accept returns or exchanges for:

Wrong size ordered (please consult size charts),
-
Buyer’s remorse or change of mind,
-
Preference-based issues (e.g., “I don’t like the colour/fabric”),
-
Failure to read product descriptions.

All change-of-mind sales are final.
6.2 Quebec & Other Provincial Cooling-Off Periods
If you reside in Quebec, you have the right to cancel this contract within 10 days after receiving the goods, without penalty or obligation to pay return shipping. To cancel, email returns@upnorthlifestyleco.com within the required timeframe. We will arrange return shipping at our expense and issue a full refund including original shipping costs.
6.3 Damaged, Defective, or Misprinted Items
We will review all claims. If we determine the product is defective, we will issue a free replacement (or refund if replacement is not possible). We may seek reimbursement from Printful separately. Claims must be submitted within 14 days of delivery.
6.4 Wrong Item Shipped
If you receive an incorrect item (different design, size, or product than ordered), we will replace it at no cost. Claims must be submitted within 14 days of delivery.
6.5 Return Shipping Costs
For approved defective/wrong-item claims: No cost to you.
For cooling-off period cancellations: Quebec residents pay no return shipping. For residents of other provinces with cooling-off periods, you pay return shipping unless your provincial law requires otherwise.
7. Pricing, Currency & Taxes
All prices are in Canadian Dollars (CAD) unless otherwise noted. Prices may change without notice.
Taxes: HST/GST/QST will be added at checkout based on your shipping address in accordance with Canadian tax laws. International customers are responsible for their local taxes and duties.
8. Intellectual Property
All branding, logos, graphics, images, text, and product designs are owned by Up North Lifestyle Co. or licensed to us. You may not:

Copy, reproduce, or distribute our designs without written permission,

Use our branding for commercial purposes,
-
Claim our designs as your own.

Unauthorized use may result in legal action.
9. Third-Party Fulfillment (Printful)
By purchasing, you acknowledge that:

Printful handles production, printing, and shipping.
-
Printful may experience delays; we will notify you of known delays.

We will review all claims. If we determine the product is defective, we will issue a replacement at our expense. We may seek reimbursement from Printful separately.
Important: You must contact us (returns@upnorthlifestyleco.com) for any order issues. Do not contact Printful directly — they will refer you back to us.
We are responsible to you for resolving order problems. If an error is caused by Printful or a carrier, we will fix it for you and then seek resolution with Printful separately.
10. Limitation of Liability
To the fullest extent permitted by applicable Canadian law:
Up North Lifestyle Co. is not liable for:

Minor colour or sizing variations (within industry standards),
-
Buyer’s remorse or change of mind (except where provincial cooling-off periods apply),
-
Indirect or consequential damages (e.g., lost profits, time, or inconvenience).
Up North Lifestyle Co. is liable for:

Defective, damaged, or misprinted products (replacement or refund),
-
Wrong items shipped (replacement),
-
Breach of applicable consumer protection statutes (which cannot be contracted out of).
Nothing in these Terms limits your rights under the Consumer Protection Act (Ontario), Consumer Protection Act (Quebec), or similar legislation.
To the extent permitted by law, our total liability to you for any claim arising from these Terms or your purchase is limited to the amount you paid for the product in question.
11. Indemnification
You agree to indemnify and hold harmless Up North Lifestyle Co., its owners, partners, and affiliates from any claims, damages, or expenses arising from:

Your breach of these Terms,

Your misuse of our website,

Your violation of any applicable laws.
12. Governing Law
These Terms are governed by the laws of Ontario, Canada and the federal laws of Canada applicable therein.
If you are a consumer residing in another province, mandatory consumer protections of your home province will apply regardless of this choice-of-law clause.
Any dispute arising from these Terms or your purchase shall be resolved exclusively in the courts of Ontario, Canada. You agree to submit to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms at any time. Material changes will be posted on our website or emailed to you. Continued use of the website after changes indicates acceptance of the updated Terms.
Updated Terms apply only to orders placed after the effective date. Orders placed before the update are governed by the previous Terms.
14. Canadian Consumer Rights Disclosure
For customers in Canada:
Nothing in these Terms limits your rights under:

Similar legislation in other provinces
These rights may include:

A cooling-off period to cancel certain distance contracts (typically 10–15 days),

A reasonable time to inspect goods for defects (beyond 7 days),

Warranty protections that cannot be waived,

The right to return defective products for refund or replacement.
If you believe these Terms conflict with your provincial rights, please contact us and we will resolve the matter in accordance with your local law.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.
16. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including strikes, natural disasters, or Printful outages.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Up North Lifestyle Co. regarding your use of our website and purchase of products. Any previous agreements, representations, or understandings are superseded.
18. No Waiver
Our failure to enforce any provision of these Terms at any time does not waive our right to enforce that provision in the future.
